Report on legal issues:

What legal issues should the HML continue to be involved?

Dr. Fred Hartmeister will review the current status of Grutter v. Bollinger. Other potential cases will be discussed as well as the HML's potential involvement.

The Horace Mann League has contributed to the development and publications of the following Amicus Curiae with the National School Boards Association:

The Good News Club v. Milford Central School (The authority of public school districts to prohibit outside groups from engaging in proselytizing activities and religious worship with elementary school students immediately after the last bell while on elementary school grounds.)

Eisenberg v. Montgomery County Public Schools (School district had a policy which denied students transfers if the transfer would compromise diversity or increase racial isolation in individual school buildings.)

Mitchell v. Helms (Taxpayers of a local public school district challenged the school district’s provision of instructional materials and equipment, including hardware to religious schools.)

Chandler v. James (Plaintiffs brought this action challenging the facial constitutionality of Alabama's statute permitting non-sectarian, non-proselytizing student-initiated prayer, invocations and benedictions during compulsory or non-compulsory school-related assemblies, sporting events, graduation ceremonies and other school-related events.)

Simmons-Harris v. Zelman (The Court’s majority holds that the Establishment Clause is no bar to Ohio’s payment of tuition at private religious elementary and middle schools under a scheme that systematically provides tax money to support the schools’ religious missions.

Grutter v. Bollinger (University of Michigan Law School appeal the district court's determination that the Law School's consideration of race and ethnicity in its admissions decisions violates the Equal Protection Clause of the Fourteenth Amendment and Title VI of the Civil Rights Act of 1964)
